Introduction

The Hi’a Ola Microbiome Test (“Hi’a Ola”), provided by Hawai’i Integrated Analytics LLC, is an AI-driven health insights company offering microbiome testing and epigenetic aging assessment services. Our services include the Hi’a Ola website, microbiome testing that analyzes stool samples, with a possible future mobile app and precision supplements.

Using our sample collection kits (“Kits”), customers collect biological samples and submit them to Hi’a Ola for testing. The samples undergo sequencing to generate data that’s analyzed using our proprietary technology to create your test results (“Test Results”). These results help assess your biological age and aging rate and provide personalized recommendations.

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO THESE TERMS OF SERVICE. IF YOU DISAGREE, DO NOT USE THE SERVICE.

1. Acceptance of Terms
These Terms govern your access to all Hi’a Ola services. By using our services or accepting these Terms, you agree to be bound by them. If Hi’a Ola determines you’ve failed to comply with any Terms, we may terminate your access immediately.

2. Services Overview
Hi’a Ola offers:
Hi’a Ola Microbiome Test: Analyzes your microbiome and epigenetic age
Precision Supplements Subscription (future offering): Personalized supplements, probiotics and prebiotics based on your test results

3. Subscription Options
Our services are available as:
Periodic Subscriptions: Annual plans with test kits and monthly supplements
One-time: Single or bundle purchases of test kits or supplements
All subscriptions automatically renew unless canceled.

Availability
Test Kits are available in the US and select international locations
Some services may not be available in certain states

Age Restrictions
We recognize three categories of minors:
Teens (ages 14-17)
Pre-Teens (ages 4-13)
Toddlers (under age 4)
Test Kits: Not designed for Toddlers or Pre-Teens

5. Sample Submission
Your Kit must be used and returned within six (6) months of purchase. Samples submitted after this period may not be processed. All samples are processed in an irreversible manner and cannot be returned once submitted.

6. Privacy and Data Use
Your use of our services is subject to our Privacy Policy (www.hiaola.com/privacy-policy). By submitting samples, you grant Hi’a Ola ownership of the samples and all data derived from them. Hi’a Ola may use this information for:
Providing and improving services
Research and development
Generating population-level analytics

7. Research Studies
Hi’a Ola may use your de-identified data in research studies. We may also invite you to participate in optional studies with external partners. Participation is voluntary and requires explicit consent. You receive no compensation for participating in studies or for any commercial products that may result from your data.

8. User Representations
By using our services, you acknowledge and agree that:
Hi’a Ola does not provide medical advice or treatment
Test Results and recommendations are for informational purposes only
You should consult healthcare providers for medical conditions
You are at least 18 years old or have parental consent
Samples you provide are your own
You assume all risks associated with using our services

9. Subscription Cancellation or Pause
You may cancel Periodic Subscriptions anytime, subject to a cancellation fee.
Following cancellation, you will not receive refunds for fees already paid and must accept any supplements already shipped or ordered for you.

10. Limited License
Hi’a Ola grants you a limited, non-exclusive license to use our services for personal, non-commercial purposes. You may not redistribute, resell, or transfer the service or materials.

11. Intellectual Property
All content and materials on our services belong to Hi’a Ola or our licensors and are protected by intellectual property laws. You may not modify, sell, distribute, or create derivative works from our content.

12. Prohibited Uses
You agree not to:
Resell or commercially use our services
Misrepresent your identity or qualification criteria
Attempt to gain unauthorized access to our systems
Upload content that infringes others’ rights
Use our services outside permitted locations
Violate any laws or regulations

13. Disclaimers
OUR SERVICE IS NOT A SUBSTITUTE FOR MEDICAL ADVICE. TEST RESULTS AND RECOMMENDATIONS ARE FOR INFORMATIONAL PURPOSES ONLY.
STATEMENTS ON OUR PRODUCTS HAVE NOT BEEN EVALUATED BY THE FDA. OUR PRODUCTS ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE.
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. HI’A OLA DOES NOT WARRANT THAT MATERIALS ARE ACCURATE OR ERROR-FREE.

14. Limitation of Liability
HI’A OLA SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID IN THE PAST MONTH OR $100, WHICHEVER IS GREATER.

15. Termination
Either you or Hi’a Ola may terminate this agreement. Hi’a Ola may terminate if:
You breach these Terms
We’re required to do so by law
We no longer provide services in your location
Providing services to you is no longer commercially viable

16. Risks and Considerations
Potential risks include:
Discomfort during sample collection
Recommendations for foods you may be allergic to
Emotional responses to test results
Security breaches despite our safeguards
Requiring medical follow-up at your expense

17. Changes to Terms
Hi’a Ola reserves the right to modify these Terms at any time. Changes are effective immediately upon posting. Your continued use constitutes acceptance of modified Terms.
